At Tuvalum we are committed to protect your data just as much as we protect ours. We only store the data that is strictly necessary to offer you a better service and an exceptional user experience. And, of course, we want you to know exactly, clearly and bluntly how our privacy policy works.

Our Privacy Policy describes how Tuvalum gathers and uses your data, as laid down by the legislation in force in the Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, concerning measures on the protection of individuals with regards to the processing of personal data and on the free movement of such data (GDPR), as well as in accordance with the applicable national regulation on data protection.

If at any stage we make any major change to our Privacy Policy, either to improve your experience when using our service or to adapt it to the regulation in force at any time, we will post it on this site and we will notify you through any other means of contact (for example, via email) so you can check it.


What is personal data?
According to current regulations, personal data is any information that relates directly or indirectly to an identified natural person. We don’t consider as personal data information with a pseudonym, or information that has been dissociated or added and, therefore, doesn’t allow to identify a natural person.


Who is responsible for the processing of personal data?
The responsible party for processing the data collected through this website is Tuvalum Sports S.L., company with the CIF B98725641 and registered office in Calle Peris Brell 23, 46022 Valencia (Spain). All comments, queries and requests regarding the use we make of your data need to be directed via email to the following address: hello@tuvalum.eu.


What Personal Data do we collect?
It is important that you know that we only collect data when you use our platform or related services when filling out forms.

Data you provide us as customer so that we can provide our services to you:

- Your name and surname(s).
- Your email.
- Your phone number.
- Your shipping address (in order to send your order or pick up a product you have sold).
- Your ID or TIN (so we can issue an invoice).
- Your billing address (so we can issue an invoice).
- Your bank account’s IBAN (when you sell, so we can pay you).

Additionally, you can give us other data that will help us provide you with better customised services, such as your height (in order to know your bike size), your photo, your birth date, your gender or your cycling club. You can edit this information from your user profile.

Data we collect automatically for the proper functioning of the platform:

- IP address from which you connect to our web.
- Device from which you connect to our web.
- Your interactions on our web (for example, the products you view).
- Usage statistics of our web (how many times you enter, etc.).
- Origin of your first visit (in order to know how you knew us).
- Geolocation data of your address.

When you register through social network authentication methods, such as Facebook Connect or Strava, we collect some personal data (for example name, surnames, photo, email, etc.) of that social network, as the applicable terms and conditions lay out. This information will depend on your own privacy settings in those platforms.

How do we use the information we gather?
Depending on the form you complete in each case (for example, when you register to sell or purchase a product or when you subscribe to our newsletter), data will be incorporated into a file of this company and it will be treated for different purposes.

When you use the services of Tuvalum as a registered user on our platform, we will handle and store your data in order to provide you with the best service we can. We will use your data specifically to:

- Meet our obligations under the contracts we sign with you in order to provide you with all the information and services you request.
- Manage your activity as a Tuvalum user.
- Prepare you orders when you buy and sell in order to collect them or send them to your address.
- Solve any type of incidence as soon as possible.
- Recommend products that you have forgotten in the payment process or that you may find interesting (for example when you ask us a customised bike).
- Inform you about offers and promotions so that you can save money on your purchase. The very nature of the service and contents of Tuvalum makes it necessary to send commercial communications to the registered users via email.
- Detect potential fraud cases during the use of our platform.
- Receive the payments you make or transfer you the payments we have charged on your behalf (i.e. when you sell a product).
- Allow you to customise your user profile.
- Allow you to communicate and interact with other registered users on Tuvalum, protecting your contact data privacy.
- Give you access to our help and advice services and allow you to communicate with our team.
- Notify you about any change in our services.

When you give us consent according to the current legislation, for example when you subscribe to our newsletter, we will send you regular communications via email with interesting news, promotional content and suggestions you may like.

The personal data you give us through the contact form will be used only to process your question or request.

We will also use your data for statistical studies that will enable us to improve our services and for basic management tasks. For instance, we regularly conduct reports on the most popular products or the bicycles that raise a particular interest. These kinds of data are only used on Tuvalum.


How do we share your data?
Tuvalum guarantees that your personal data will not be given to third parties without your knowledge. However, we need to share some data with other companies in order to provide our services, for example, with our partner delivery companies that ship your purchases to your home, or our email marketing tool that notifies you when your product has been sold. We share your data specifically with:

- Our logistics and shipping providers. They need to know your name and surname(s), email, phone number and address in order to pick up the products you have sold or send you what you have bought.
- Our CRM tools, email marketing, analytics and other professional service partners. This includes direct advertising platforms such as Facebook Ads or Google Adwords that we use to show you Tuvalum’s promotions.
- Our financial tool and payment providers, including first level financial institutions (Cetelem, RedSys, Stripe, PayPal, Aplazame, Banco Sabadell, etc.).
- Other companies and providers you approve.

We inform you that Tuvalum may provide personal details and any other information that has been obtained through their computer systems to the competent public authorities as required under the legal and regulatory provisions that may be applicable to the case. For example, if the police asks for personal data for fraud prevention purposes or to investigate the sale of possible stolen bicycles, we will provide it.


How do we protect your data?
Tuvalum guarantees that the appropriate security measures are in place in their facilities, systems and files. Your personal data will be treated with confidentiality, in accordance with the current legislation, in order to protect you against any non-authorised access, unlawful processing or accidental loss.

All payments are processed through first-class payment gateways and financial institutions in accordance with the most advanced security standards. The bank data you enter is encrypted and transmitted safely to the bank institution's servers, and then, it is verified in order to prevent fraud and abuse. Tuvalum has no access to the bank data related to the online payment methods, so they don’t access or record them at any time. Just to give you a general idea, it is safer to purchase online at Tuvalum than to pay at a restaurant or gas station.

We use SSL (Secure Socket Layer) encryption protocol for data encryption. It is one of the most effective protection systems and it ensures that third-parties will not have access via Internet to your bank information. This data is recorded in an encrypted form.


How long do we store your data for?
We store your personal data in our system as long as we need in order to:

- Provide you with our services, including information related to the help that our customer service team offers.
- Meet all legal obligations in order to provide our service.
- Meet any legal requirements that become a priority over Tuvalum.

In any case, the data storage period changes depending on the context of the service we provide or the legal obligations we are subject to. For example, the current legislation forces us to maintain the financial records for a specific time. For this reason, we may store some of your data after you close your account.


What are your rights over your personal data?
You have some rights regarding your personal data. In addition to your right to be informed about how we use your data, you also have the right to:

- Access the data we have about you.
- Ask for the correction of inaccurate personal data we have about you.
- Request the transfer of your data to you or to other service providers.
- Stop receiving promotional messages and our newsletter via email. All the newsletters we send include a link to unsubscribe. You can also do it from your user account.
- File a complaint to the regulatory body of data protection.
- Request the deletion and removal of your data.

You can request a copy of the personal data we store on Tuvalum at any time. Send an email to hello@tuvalum.eu with the subject “My personal data”. For security reasons, we will need to verify the applicant’s identity, so you will have to send us the email from the same email address you used to register at Tuvalum. Moreover, we will ask you to provide a copy of your ID card, electronic signature or scanned copy of the ID card, in accordance with the minimum legally established content. As outlined in the current legislation, we will send you the information within 30 days.

You can delete your personal data. In order to do so, you will need to unsubscribe deleting your Tuvalum account. Once that’s done, this data will not be accessible in the future. Once you ask Tuvalum to delete your personal data, it will be dissociated from you. This means that no one can identify you with the data remaining in our systems. This dissociated information we keep will be used by Tuvalum for statistical and/or commercial purposes.


What are your responsibilities over your personal data?
By accepting the privacy policy and Tuvalum’s terms and conditions, you agree to provide true, correct and complete personal data, as well as to keep it up to date. Tuvalum reserves the right deny services to any users providing false data, notwithstanding any other actions applicable under the UE Regulation.

You will also be responsible for the information you provide, the contents you post and the messages you share on any of our platforms. This includes posting ads on our website, sending messages to other users through our service or writing comments in our blog or social networks. You are the only responsible party for your contents, ensuring Tuvalum has full indemnity against any third party claims that might arise in relation with them. If those contents include material that is protected by intellectual or industrial property rights, you guarantee that you are its owner or that you have the owner’s permission to share it.

It is completely forbidden to post promotions and links to commercial offers, advertising, promotional material, chain letters or any other direct or indirect promotional activity or any other comment that doesn’t adjust to the normal course of the services of Tuvalum.

Since the services of Tuvalum connect people, you agree to respect other users. Tuvalum reserves the right to reproduce, edit, distribute or delete those contents and/or data that might be perceived as harmful to the rights of third parties. The user shall exonerate Tuvalum against any claim that might occur for the messages the user shares on the web, blogs, social networks or for any other behaviour linked to or derived from his/her use of the different Tuvalum channels.


Resumes and job offers related data
Sometimes we post job vacancies and we receive resumes from applicants via email or different authorised providers (Infojobs, Tecnoempleo or similar sites). If you send us your resume, you should know that we will store the data you provide for a year in order to analyse and evaluate it. Under no circumstances will we give it to third parties without your permission. In compliance with the Data Protection Regulation, the data collected in these forms will be used for the purposes, in the manner and with the limitations and rights described herein. After one year, we will remove that data.
